I have been watching the American show THE GOOD WIFE and find it so thought provoking. I am happy to jot down whatever pops into my mind, and hope I won't bore you all!

I read the plot summary and watched a few clips in the past but couldn't get into it. Maybe you will spark my interest again.

My favorite shows on this genre are Boston Legal (bright side) and The Practice (dark side). One of my friends will bash Boston Legal on any day for The Good Wife though.

I find those legal terms hard as well, but I don't mind putting extra time into it! The reason I set my mind on this show is that I can give myself a big push and see if I could make a big leap forward!!!

Sometimes, pressure makes me a bit more motivated! Please keep an eye on me and see how it pans out for me!

Fair enough!

It's where most of the American shows have headed for, isn't it? They drag on and on until the audience get fed up with the stretchy plots!

However, I decided to dance around the tune those play-writers have set up for me!

I am watching Franklin and Bash now. I've decided to only watch light funny shows

Problem with The Good wife is that........ what kind of law firm partner would love a woman for decades and take on to her husband even if he is the Attorney General?!! Doesn't make sense... No lawyer would go that far for love...

Reflections on Take 1:

I just can't imagine how much more strength Alicia needs to hold her composure not to cry in the public, to channel inside all the anger and frustration she might go through. As a dedicated housewife, whose husband holds a public office and commits the infidelity, she still has to hold her head high in public, hold her husband's hands tight and return to the public in silence that they are united in resilience to defend against whatever worst that might come along!

Even crying a river inside, Alicia is still committed to her role in supporting her husband. I was almost reduced to tears when Alicia was desperate to get rid of a tiny fiber from Peter's suit while he was addressing to the media on his resignation after being accused of abusing his political power and dealing with prostitutes.

Case Law
Legal principles enunciated and embodied in judicial decisions that are derived from the application of particular areas of law to the facts of individual cases.

As opposed to statutes—legislative acts that proscribe certain conduct by demanding or prohibiting something or that declare the legality of particular acts—case law is a dynamic and constantly developing body of law. Each case contains a portion wherein the facts of the controversy are set forth as well as the holding and dicta—an explanation of how the judge arrived at a particular conclusion. In addition, a case might contain concurring and dissenting opinions of other judges.

Since the U.S. legal system has a common-law system, higher court decisions are binding on lower courts in cases with similar facts that raise similar issues. The concept of precedent, or Stare Decisis, means to follow or adhere to previously decided cases in judging the case at bar. It means that appellate case law should be considered as binding upon lower courts.

Reasonable Doubt
A standard of proof that must be surpassed to convict an accused in a criminal proceeding.

Reasonable doubt is a standard of proof used in criminal trials. When a criminal defendant is prosecuted, the prosecutor must prove the defendant's guilt Beyond a Reasonable Doubt. If the jury—or the judge in a bench trial—has a reasonable doubt as to the defendant's guilt, the jury or judge should pronounce the defendant not guilty. Conversely, if the jurors or judge have no doubt as to the defendant's guilt, or if their only doubts are unreasonable doubts, then the prosecutor has proven the defendant's guilt beyond a reasonable doubt and the defendant should be pronounced guilty.

Reasonable doubt is the highest standard of proof used in court. In civil litigation the standard of proof is either proof by a preponderance of the evidence or proof by clear and convincing evidence. These are lower burdens of proof. A preponderance of the evidence simply means that one side has more evidence in its favor than the other, even by the smallest degree. Clear and convincing evidence is evidence that establishes a high probability that the fact sought to be proved is true. The main reason that the high proof standard of reasonable doubt is used in criminal trials is that criminal trials can result in the deprivation of a defendant's liberty or in the defendant's death, outcomes far more severe than occur in civil trials where money damages are the common remedy.

Notes:

Jury system--Used in criminal law, in which jury is comprised of 12 members. To convict an accused,  at least 10 out of 12 members have to be convinced of the accused's guilt based on all the evidences admitted into that case.  However, if it is 一级谋杀刑事案件，只要其中任何一个人有不同意见，法庭都不能宣判。(Please refer to @江南柴进 's post: http://freeoz.org/ibbs/forum.php?mod=viewthread&tid=986535 )

Jury selection rule--Any citizens can be chosen to be a member of a jury panel, and all citizens have the legal responsibility to serve the jury's duty whenever called upon.

However, the candidate has to have no knowledge about what is going on with the particular case he/she serves, just in case, his/her preemptive perception could possibly impair the accused's fair trial. He/she has to be an impartial person when it comes to a particular culture, religion and population. For instance, if a potential jury member is found to have a bias on muslin, he/she won't be able to be selected to a jury panel who are about to hear the case that involves any muslin people.  Just in case, that bias will play a negative role in muslin suspect's fair trial.

That's why as long as a murder case becomes a high profile one, it will get extremely hard to select the jury panel. Then, the trial will be unbearably postponed and unfavorably affect the victims.

Also, as long as the jury panel is established, all members will be isolated from the public contact. They are not allowed to read newspapers, watch any TV programs relevant to the case in trial, to discuss with any outsiders about the case. Their only source of information about the case is from the court room.

So, in the process of the trial, if any jury member broke the rules, the whole trial would be coming to an abrupt end, the jury panel would be dismissed and re-selected!

I guess that's one of the reasons when the judge pronounces an accused's guilt, he always can make such a statement confidently: Your guilt of murdering the deceased is beyond reasonable doubt!

楼主真好
补充一点，预审是英美法系优势的一大体现，通过预审很多案件可以免于起诉，大大节省了纳税人的钱。

大家看电影学法律的话，我提醒一下，澳洲法律跟美国法律在很多方面是不一样的哦。。。不能完全依赖电影电视哦，有问题还是要找律师的

Even in The States, what the law says and how it is interpreted will be different in reality and movies. Here, we  are just having fun understanding the show: The Good Wife in particular!

Would you mind sharing with us how it works in legal land in Australia, counselor?

It will be coming handy if we understand some basic civil laws. We are not looking for trouble, but at least we are aware of it when our civil rights are violated, only at this stage will we realize the legal assistance should be sought!

It feels different when I have to make sure what I got from the show than just watch it leisurely and don't mind if I missed out on some point!

But, I am so glad that I have taken on this challenge. It pushes me over the edge, but I will definitely end up knowing more about the legal terms and stuff!

Three years have passed and I guess @yping88 has started following The Good Fight as well? I haven't found myself enough time to binge The Good Wife or The Good Fight, but I did manage to finish another show which is a worthy competitor - Silk.

Time is a big killer, isn't it! While I am blinking, 3 years slipped away! But, I didn't let it slip away easy. Heeeheee. During all this time that I was absent from FreeOz, I had done Great Ocean Road walking trail, Wilson Prom Trail, OverLand Track. I have been to Canada, The States, South America...

Traveling around absolutely teaches me to look at life in a different perspective, helps me to realize that a lot of things could have been done differently!

Do you happen to use VPN in your computer that may actually get you blocked from the firewall of China? The link I posted is from Douban. Here is the page from IMDB.

It's a British legal dramma with a strong cast of main characters and a very solid story line. It has some weakness, like some of the support roles which are somewhat distracting and sometimes incoherent character development. But overall I consider it an excellent show.
