根据美国国会今天批准的一项移民法规,澳大利亚人将能比以前更容易在美国工作和生活。<br>
<br>
美国新的法规增加了一个新的签证类别-E3签证,专门允许澳大利亚人在美国工作和生活两年。而且获得这类签证的澳大利亚人可以无限期延续该签证。目前美国政府已经准备了一万零五百个E3签证,授予拥有学士学位和相关工作经验的人。<br>
<br>
这项新的立法意味着澳大利亚人在美国工作的机会大大增加,因为在这项立法实施之前要前往美国工作的澳大利亚人必须竞争美国面向全球的每年六万五千个H1B签证。另一项重大变更是获得E3签证者的配偶也可以在美国工作。这也是先前法律所禁止的。 <br>

The New E-3 Visa for Australians – FAQs<br>

Congress has created a new work visa category for Australians that in many respects will make it one of the most attractive visas in US immigration law. The new law will largely take Australians out of the H-1B quota (which has a long queue right now) and offer them a visa that is similar, but more flexible than the H-1B. It also has some of the elements of an E treaty visa and can be viewed as a hybrid that should be highly useful to Australian nationals seeking work in the US.<br>
<br>
What is the new E-3 visa?<br>
<br>
Section 501 of the Real ID Act of 2005 has made a change to the Immigration and Nationality Act to allow for a new category of E treaty visa. This change creates a new INA Section, Section 101(a)(15)(E)(iii), which allows for the admission of an alien who is a national of the Commonwealth of Australia, and who is entering to perform services in a "specialty occupation."<br>
<br>
What is a specialty occupation?<br>
<br>
The term "specialty occupation" means an occupation that requires theoretical and practical application of a body of highly specialized knowledge, and attainment of a bachelor's or higher degree in the specific specialty (or its equivalent) as a minimum for entry into the occupation in the United States. The definition is the same as the Immigration and Nationality Act definition of an H-1B “specialty occupation.”<br>
<br>
What is required of petitioning employers?<br>
<br>
The petitioning employer will be required to file a Labor Condition Application with the Secretary of Labor as required under Section 212(t)(1). The process for this should be virtually identical to the process currently used with H-1Bs. Employers must also file labor condition applications like in H-1B cases and make the same attestations including those regarding paying the prevailing and actual wages, not breaking up strikes, maintaining public access files, etc.<br>
<br>
Is there a limit on the number of E-3 visas that will be issued?<br>
<br>
The number of E-3 visas that will be issued will be limited to 10,500 per fiscal year. The spouse and children of the E-3 are allowed to accompany or follow to join the principal, and such spouses and children will not count against the 10,500 cap.<br>
<br>
What are the time limits on E-3s?<br>
<br>
E-3 I-94 time limits are the same as E-1 and E-2 visas (as opposed to H-1Bs). More significant, however, is that they can be renewed indefinitely.<br>
<br>
Can spouses of E-3s work?<br>
<br>
Unlike H-4s, spouses of E visa holders are entitled to work authorization.<br>
<br>
Can I convert from H-1B to E-3 status?<br>
<br>
The statute does not bar this and it should be possible to change from H-1B to E-3 status.<br>
<br>
When can I file for an E-3?<br>
<br>
In theory, applications can be submitted immediately as implementing regulations are not required. In practice, USCIS may not adjudicate these cases until they have at least established guidelines.<br>
<br>
Interestingly, one might simply apply for an E-3 at a consulate and bypass USCIS. The applicant would need to present an LCA and the other documents required above, but USCIS should not have to approve it in advance. This would mean that E-3 applicants can secure visas within days of applying and be in the US quickly.<br>
<br>
We will have to wait and see what USCIS and DOS announce, however.<br>
<br>
Is the E-3 a dual intent visa?<br>
<br>
They are not dual intent in the sense of H-1Bs and L-1s, but they do not have a foreign residence requirement. Applicants need to attest that they intend to depart when their status terminates. A statement is usually enough unless they have clear intentions showing the opposite. But there is case law stating that the expression of a desire to remain in the US permanently as opposed to intending to remain even if legally not permitted, is permissible on an E visa. In other words, wanting to remain permanently is okay as long as one is willing to leave if this is not permitted by law.<br>
<br>
E visa applicants also need not demonstrate that they are coming for a limited period of time and they do not need to show a home in their home country to which they plan to return. This would be impractical given the fact that E visa holders can remain in the US for decades.<br>
<br>
What are the fees for an E-3 visa?<br>
We don’t know what USCIS will charge for a change of status to an E-3 visa but it will presumably be the same as for the E-1 and E-2 categories ($185). However, the expensive H-1B fees included in the recent H-1B legislation (ranging from $1250 to $2000don’t appear to apply to this category. Consular fees should be the same as for other E visas.<br>

ELEANOR HALL: The Howard Government's close relationship with the Bush administration has secured a major easing of immigration restrictions for Australians wanting to work in the United States.<br>
<br>
United States Congress today voted to create a new visa, giving preferred status to Australians.<br>
<br>
A leading expert in the field, American law firm Siskind Susser, describes the new deal as "one of the most attractive visas in US immigration law".<br>
<br>
But the changes will be controversial in the US.<br>
<br>
In fact, as correspondent Leigh Sales reports from Washington, Australian officials have tried to keep negotiations for the deal secret to prevent anti-immigration lobbyists from persuading members of the Congress to vote against it.<br>
<br>
PRESIDENT OF THE SENATE: Are there any Senators in the chamber wishing to vote or change their vote? If not, the yeas are 100, the nays are zero, the conference report is agreed to.<br>
<br>
LEIGH SALES: Ten thousand five hundred of these new E3 visas will be available to people with university degrees and work experience.<br>
<br>
There are three reasons why the change is so significant.<br>
<br>
Firstly, Australians currently have to compete globally for just 65,000 work visas, known as H1Bs, and end up with just a handful.<br>
<br>
This reform specifically allocates Australians 10,500 of their own visas, greatly opening the number of work opportunities.<br>
<br>
Secondly, the new E3 visas can be renewed indefinitely once you have one. At the moment, there's a six-year limit.<br>
<br>
Thirdly, the spouse of an E3 visa holder will also be able to work in the US.<br>
<br>
Frances Cassidy is the Director of the American Australian Association in New York.<br>

FRANCES CASSIDY: I just think this is a fantastic development because we've had so many instances where US based companies want to bring people in from Australia and have been stymied because of the restrictions on the quota levels for the other business visas that are available.<br>
<br>
LEIGH SALES: So what will be the impact on the business community?<br>
<br>
FRANCES CASSIDY: Well I think it'll mean that people with special skills coming out of Australia, it'll be much easier for them to have access to transfer into the United States. And the fact that this visa is renewable and also has opportunity to give spouses work rights is going to be such a big improvement to facilitate transferring skilled personnel into the United States.<br>
<br>
LEIGH SALES: Those provisions are fairly extraordinary; do any other countries have anything similar?<br>
<br>
FRANCES CASSIDY: Not that I'm aware of. I'm not quite sure what Canada and Mexico have under the NAFTA arrangements, but this is certainly a very special arrangement for Australia, and I think reflects the closeness in the relationship between the US administration and the Australian Government.<br>
<br>
LEIGH SALES: The changes will be controversial in the US, where there's been an increase in anti-immigration sentiment post-September 11.<br>
<br>
Some groups feel the Bush administration should be restricting visas for security reasons.<br>
<br>
They are also the usual concerns about jobs going to foreigners when they should go to Americans.<br>
<br>
FRANCES CASSIDY: I wouldn't expect there to be controversy, but I know there probably will be, because there's a strong movement here to restrict freeing up any visas for people coming into the Unites States.<br>
<br>
I mean, Australia is considered a safe country, but nevertheless, there are groups here that don't care where people are coming from, they just don't want to see visa rules relaxed.<br>
<br>
LEIGH SALES: Australian officials in Washington were aware of the potential for controversy and kept negotiations for the deal top secret to prevent anti-immigration activists from lobbying members of Congress to vote against it.<br>
<br>
One of the tactics included attaching the Australian changes to a much more significant piece of legislation, a Bill approving more money for the wars in Afghanistan and Iraq.<br>
<br>
That meant the Australian deal slipped through with little discussion or attention, and it also ensured the Bill was voted on swiftly, because it was attached to something of high importance.<br>
<br>

【***10月31日讯】大家都知道,外国人如果想在美国短期合法工作,除了绿卡持有人之外,都需要申请工作签证。目前最常见,也是最多人申请的,应该说是H -1B工作签证。现在,澳大利亚公民申请人又有了一个新的赴美工作的选择,这就是根据新通过的2005年国防与国际反恐紧急拨款法案所创立的E-3签证。今年9月,有关这项新的签证种类的执行条例已正式公布。<br>
<br>
E-3 签证是移民法根据美国与澳大利亚之间签署的自由贸易协议创立的专用于澳大利亚公民赴美从事专业服务的一种工作签证,其全称是“E-3 Treaty Professional Visa for Australian Nationals”。与传统的H-1B签证相比,E-3签证有¨以下几项明显的优势:<br>
<br>
1. 名额相对宽裕<br>
<br>
E-3签证每年将有10,500个名额。虽然这个数字表面上看起来远远少于H-1B签证的每年6万5千个名额,但是考虑到这一万多名额将仅用于是澳大利亚公民的申请人,而H-1B的名额却有全世界的申请人在竞争,E-3签证的名额显然要宽裕很多。还有一个数字也可以清楚地说明E-3签证名额之宽裕。根据移民局的统计,在2004年,只有900个澳大利亚公民申请到了H-1B签证。从区区9百一下子跳到了1万五百,预计E-3签证的名额将会是绰绰有余的。<br>
<br>
2. 申请费用低<br>
<br>
自今年3月8日起,H-1B的申请费已经大幅度上调。而且从10月26日起,移民局又再次调高了各项申请的申请费,其中自然也包括H-1B的申请。如此高额的申请费对申请人来说无疑是一项不小的负担,有时甚至会成为得到工作机会的障碍。E-3签证的申请费仅仅是100美元左右。两相比较,E-3的费用显然要低廉许多。<br>
<br>
3. 可以无限制延期<br>
<br>
众所周知,H-1B签证一次有效期是3年,到期可以申请延期一次,也就是说,一般情况下一个人最多可以有6年的H-1B。而E-3签证虽然一次有效期2年,但是没有延期次数的限制,也就是说,只要有工作,你尽可以在美国居住工作几十年,而无需担心身份过期问题。<br>
<br>
4. 配偶也可以工作<br>
<br>
H- 1B签证持有人的配偶及子女持H-4签证,但H-4签证持有人不可以在美国工作。但是,新法条允许E-3签证持有人的配偶在美国工作,并且,这种工作并不需要是要求本科以上学历的专业职业。此外,虽然E-3签证的申请人必须是澳大利亚公民,但其配偶子女不受国籍限制,并且配偶子女的签证不计入每年的1 万5百个名额当中。<br>
<br>
鉴于E-3与H-1B相比有¨如此多的优越性,如果你符合E-3签证的申请条件,你不必再为等H-1B名额烦恼了,你有了赴美工作的更好选择:申请E-3签证。<br>
<br>
那么,申请E-3签证必须具备哪些条件呢?<br>
<br>
首先,E-3签证的申请人目前还只限于澳大利亚公民及其配偶及子女,不包括绿卡持有人。<br>
<br>
其次,E-3签证的主申请人在美国有工作机会。工作机会可以是美国公司或者澳大利亚公司在美国的分公司提供的工作机会。<br>
<br>
第三,该工作机会必须是从事专业职业的工作。所谓专业职业,是指所从事的工作要求一定的理论及实践知识,必须是有本科或同等学历以上的人才能胜任。据悉,使领馆官员将被指导运用有关H-1B工作签证的法律法规来界定一个职位是否属于专业职业。<br>
<br>
第四,E-3签证的主申请人必须至少有学士或同等文凭。具有多年工作经验也可能通过专业公司评估成相当大学文凭。<br>

2005年5月10日, 美国国会投票通过了911以来极为罕见的开放美国移民政策的HR1268提案, HR1268创造了一个新的E-3Visa, 布什总统已经在2005年5月11日签字,HR1268已经正式成为法律,正式实行估计还要等几个月. E-3签证是专门发放给澳洲公民的工作非移民签证, 每年名额10500个. 由于细则还在制定中, 所以下面列出的可能跟实际条款稍有出入, 但这个法律的实施肯定是板上钉钉了. <br>

E-3签证申请条件: <br>
<br>
1, 澳洲公民, 注意, 不是澳大利亚绿卡哦 <br>
2, 本科学历(tertiary qualifications/ Bachelor Degree)及以上或认可的专业领域经验. <br>
3, 有Job Offer以及雇主的SPONSORSHIP(和H1B一模一样), 并且职业是"Specialty Occupation" The definition of the specialty occupation is same as H-1B visa. <br>

E-3签证的条款 <br>
<br>
1, 两年有效, 可续, 爱续多久续多久, 只要是有工作,那就是说你可以在美国呆几十年强 <br>

2, E3签证的配偶可以工作,有工作许可EAD(比H1B强多了), 以及未成年子女又可以打工又 <br>

美国新设特优澳洲人工作签证类别<br>

E3系美国政府最新设立的一种专门针对澳洲国民的工作签证类别,是去年澳美自由贸易谈判协议中派生出的一个副产品,其申请程序中省去了许多对其它国家公民的限制条款。<br>
<br>
这种新签证每次允许持证人及其配偶在美国工作两年,且可以无限制地多次申请续签,为数有限的几项条件中包括,申请人必须有雇主资助、具备相当学士学位以上的教育程度或具备某项专长。<br>

该签证每年的签发限额为1.05万人,不过到1月底只有492澳洲人获得签证,这应该是因为许多人还不了解E3。据了解,美国每年签发多达6.5万H-1B 类工作签证,而这1.05万个名额并不在此列;新加坡和智利与美国之间也同样有自由贸易协议,但是只获得了有限的新签证名额,并且还是包含在通常工作签证名额之内的。<br>

美驻澳大使馆的高级外交官斯坦顿(Bill Stanton)介绍,他很高兴地看到那么多的澳洲专业人才有意前往美国发展,特别是会计师、工程师、律师均会成为这一新签证类别的受益者。<br>
<br>
根据美国最近的人口普查结果,有大约7.8万名澳洲人生活在美国,其中约4.1万人在d当地工作,很明显新签证名额将大大增加澳洲人在美的工作机会,同时也会使更多的澳洲生意人移民美国,如此一来,美国将同英国一样成为澳洲人寻求海外工作的首选地。<br>

刚刚获得E3签证的凯勒(Pensiri Keller) 女士对快速简洁的审批手续颇感满意,她高兴地向记者介绍说,人生旅途中去亲身体验一下异国他乡的生活,已成为许多年轻澳洲人的时尚与愿望。而几年的留美经历中,她发现旅美澳洲人的爱国心特别强烈。<br>

这样一来澳大利亚的高福利和美国的高工资两边的好处都占了,而美国对绿卡持有者没有什么公共福利,所以申请不申请美国绿卡都可以。

本人和家人的 教育和医疗的福利呢
按照外国人?
还是有TREATY可以按照NATIONAL来算的?
