标题: 176,475前两年工作地点及之后转PR问题，欢迎讨论（2.6新增一个小问题）
1.176,475和175的区别应该就是要在特定地区住满2年，切工作满一年，之后就和175相同，可以全澳洲去居住工作了？

2.看了陈赖版的一个帖子，对于475，前两年可以去别的州的偏远地区工作。那么对于176，前两年是否也可以跑出指定的州，去其他州居住工作？

3.两年内的工作经历应该工作类型不限，不一定是申请的SOL，站超市片鸡肉都可以，只要满足工作时间和薪水要求？

2.6新增问题：
对于176，和475来说，找工作的时候是否雇主一般都会check 签证类型，比如176去担保洲外工作，475去其他州偏远地区工作，要是遇上较真的雇主，也就拿不到offer，只能在老地方呆着了？

啥意思？比如说西澳担保的475下签后可以不在西澳的边远地区而是到别的州的边远地区去工作生活？

176是要在州担保所在州住满前2年，事实上，如果你到所担保的州后，去了其他州，也不会管你（但是，最好呆在所申请的州，因为担保协议是这么签的）。176本身就是PR，无需转，只是与175有区别，175是只要在澳大利亚，无论哪里都可以，就是说无地域限制。

我之前的讨论得出的结论是

176其实更自由，只要提交所在州租房，手机入网协议什么的，政府即认为你在那里生活了; 真要跑出州，也没人知道。换言之，真要跑，到续签pr的时候拿的出材料，就能过关。暂时没听说可以名正言顺通知政府的例子

赖版终于出马了，其实我觉得大多数技术移民过去基本还是跟着工作走，哪里有工作，就在哪里居住。

其实关于176和475我有一个半规避的想法，如果是夫妻二人申请：然后主申先按照176或者475的要求在所在州偏远或者所在州呆满2年，打labor熬一下，之后享有175同样的自由后，副申再过来。总好过两人一起熬两年，都不做原先专业的工作（尤其是IT荒了两年，之后找工作更难，还不如在国内继续IT着）要好点。
不知道这种牺牲主申，掩护副申的法子是否合乎规定，这样的话，是否2年后副申过来后就不用再有2年必须呆在某个州的限制了？

你要相信自己的眼睛。。 676多次往返签证，每次可以待3个月那种也是一样的。我妈的676多次往返是一年有效期，但是我妈却在澳洲合法待了近15个月，这些是我家人亲自实践过的事情。

换句话说，持475签证的人可以在澳洲最多待6年，如果不想转PR的话

我的enter before date就是我体检或无刑最早的那个时间往后推1年。就是激活签证的那个首次登陆时间。
我是2011.11.15体检，2011.12.10作出无刑公证，最后我的enter before date就是2012.11.15

475的话，只要一个人满足条件就可以了，随便主还是副都可以
另一个人可以在国内“享福“，到了转887的时候，全家都要在澳洲境内

以前在另外一个版块看到过一篇关于176两年内是否可以随便跑的讨论。那篇文章的版主写信给SA的移民局询问了，并且贴出来移民局的回复，可以看到移民局是很不高兴的，并且指出希望他能认真考虑自己的moral obligation。我觉得说的比较重了，我之所以能把这篇帖子搜出来，就是记得“moral obligation”这两个关键字，呵呵。

其实我对这个问题的看法一直没变过：176，475的存在自然有它们自己本身的意义，谁给你担保的，OK，做个诚实诚信的人，为当地做出你该做出的贡献。至于澳洲政府的人性化，不应该成为你滥用的一个对象。当然只是我个人看法。就像这个帖子的17楼fatbighead所说的，只有moral obligation能限制你，而法律上你是自由的（参见我下一楼的帖子）。

其实176和475是一样的。下面以176为例子。

As I have previously stated (link below) there is no legal requirement under the 176 GSM visa scheme that requires you to remain in the sponsoring state for the two year period. HOWEVER consider that you would have given your word, made a promise, to do so.. I would strongly suggest you dont abuse the trust that the state have put in you as this may not directly affect you but will likely others.

最后提到的‘as this may not directly affect you but will likely others’，讨论的是如果大家都滥用这种自由的话，后果是什么呢？

说句不好听的话，其实是我Phd导师（也是华人）的原话，‘中国人喜欢钻空子，还经常以为老外傻，真是太天真的，结果中国人很多落得个不好的名声’。为啥落得个不好的名声？很大一部分原因就是没有打心里看重‘moral obligation’这个事情。

再者，何为钻空子？个人理解就是法律的空子，人情的空子。澳洲是讲法律的地方，也是人性化的地方，但是不代表这种法律的空子和人性化就应该成为大家滥用的对象。

There is no legal condition on your 176 visa to stay in the state that sponsored you for 2 years. The only government authority that can impose legal 'conditions' is the Federal government since they have the power over the immigration area and issues migrant visas.

State sponsorship is a state government function and you do agree with the state that you will live there for 2 yrs. But you are not legally obligated to do so. You are not legally obligated to even call them and ask their permission to leave the state!

Nor is it correct to say that moving out of the state that sponsored you before the 2 years is up will affect your citizenship application. That is simply not true. Citizenship is granted by the Federal government.

可以看出这个人的看法是（我看分析得很合理）：176跨出担保区域对你将来入籍是没有任何影响的。176签证持有人可以把176 PR当175 PR使，至少在法律层面是这样的。

I have sent an email to migration deptt. of SA describing my circumstances and requesting them to remove the visa condition. Whenever I will get a responce I will post the update here.

该帖子楼主打算向SA州政府申请免除176的签证‘限制’。（单引号表示，其实根本不存在这个限制）

To confirm: there is no visa condition such that you are at risk of losing your visa if you do not live in the sponsoring State.

It is though a courtesy to keep the sponsoring State informed of your situation and intentions.

多谢啦，看来能不犯规还是不要犯规，对于176，是否可以主申一个人先在担保洲呆2年，副申在国内呆着，2年后可以自由区各州时，副申再过去？

或者副申去呆两年，主申国内留守，自由后主申再过去？

请问这是在哪里看到这段话的? 为什么我收到的WA州担保书上不是这样写的呢? 没有看到"Applicants using Western Australian state sponsorship are required to live in Western Australia for at least the first 2 years after visa grant."呀...

我收到的是这样的:

Please note Western Australia Government sponsorship is not automatically transferable to any other State or Territory in Australia. You are required to seek the endorsement of the Small Business Development Corporation before making any plans to relocate to any other State or Territory in Australia.

In addition, you will need to seek the approval of the Small Business Development Corporation before making any changes in the commitments made in your application in preparation for sponsorship of your permanent residency visa.

然后附了一份STATE SPONSORSHIP AGREEMENT, 上面的commitment是这样的:

1. You remain living and working in Western Australia;
2. You keep the Western Australia Government informed of your contact details after your arrival;
3. You complete a settlement survey every six months for a period of 24 months; and
4, You transfer around A$35000 into Western Australia for living costs and domestic arrangements.

翻遍了也没有看到要first 2 years呀... 所以这里想问一下各位大侠, 根据以上收到的州担保书和commitment的内容, 是不是可以先去别的州工作, 然后在签证的最后2年到西澳呆着就可以了? 如果这样做了, 会对签证到期后转RRV或者以后的入籍有影响吗?

看来WA担保书有变化，现在最新的版本是有明确规定不能去别的州了，我是说475，176不知道

这是维多利亚州的，不知道其他州如何

规定很明确啊，前2年居住要求，
（没说一定要工作满1年，那是475）

最后一句话显示了SA DIAC的无奈。。。无法阻止你出SA的话，唯一能做的就是删系统啦

是这样说的:

这里的也没有提到要first 2 years, 只是说2 years upon arrival, 这个arrival是指Australia还是指WA?

我是维州的州担保176，维州是要求前2年（first 2 years）居住在维州，对资金（sufficient fund）也没有要求，是不是各州的担保条件不一样，你可以写信去问问WA, 就用当时申请的邮箱就可以.

我对475不怎么了解，这里说说我最近对176的更新理解。

原来我认为，176在用签证入境后，对担保州有道义上的责任在所在州居住头两年。事实上这个肯定是头两年，什么5年中的两年是没有意义的。因为其一，PR签证是永久居住签证，并不存在期限。所谓5年只不过是在不入籍的情况下随意出入境的期限。其二，一旦定居下来，有了稳定工作，一般来说极不可能扔下工作和家庭再搬到另一个州，尤其是在你有充分动机离开担保州去其他州寻找工作的情况下，这种设想更不现实。但是如果在担保州找不到工作，离开也是一种合情合理的选择。

但是“找不到工作”的定义，也是一个灰色地带当中的概念。你可以说鸡场蘑菇厂是工作，你也可以说专业工才算工作，或者也可以说只有工资和档次相当的专业工才算合格的工作。事实上，如果从事的专业对于经验和技能要求比较高的话，2年的鸡场或者低端的专业工作对你而言很可能就不光光是损失一点金钱那么简单，也许在2年以后你会被完全排斥在原先的职业圈子之外。这种情况下，moral obligation是否还是那么合理呢？进一步，如果现在的薪水生活没有问题，但是在另外一个州从事相同的职业，收入是担保州的两倍，那么离开担保州是否足够正当呢？为了多一些钱违背诺言，是否太不厚道了一点？这一点在pomsinoz上，英国的鬼佬之间也有激烈的争论。从已经写给州政府的信得到的反馈来看，政府的态度一般是这样的。第一，我们给你出担保，是因为你承诺你有genuine的动机在我们州居住。第二，我们在给你发担保之前也得到你的书面承诺说你已经对我们州的就业前景做过充分研究，认为在我们州不会遇到找工问题。第三，我们当然不会限制你去其他州但是希望你考虑自己的承诺。第四，如果你还是决定离开，我们这边没有问题，希望你以后能回到我们州。基本上是一套一样的话。当然不同的州态度会有所不同，好像SA比较缺人，政府比较着急。

问题是，我从一个信誉不错的猎头那边听说，这种规定也只是纸面上的规定。长凳半年多以来，我也意识到OZ的政府在有些问题上也并不那么直接明了。在某些领域，确实存在一些“潜规则”（当然跟国内完全不能相比）。政府那边，有一些事情是不能公开说的。因此你从官方渠道不可能得到正确答案。如果大家都知道，其实从一开始就没打算限制你去哪儿，那么放弃更好的职业发展死呆在担保州是否显得很傻很天真呢？后来我从一个朋友那边得知，VIC的176好像去其他州没有任何问题。

从法律体系来讲，176确实没有法律上的义务呆在担保州。因为首先，迁徙自由是基本人权，法律地位远远高于承诺和合同。其次，OZ的各个州政府没有移民事务的决定权。移民、预算、国防都是由联邦政府掌管的。因此纠正一点，不存在所谓SA移民局或者NSW移民局。虽然在SA有DIAC的office，但是那个是联邦政府的office，就和美国国会在华盛顿一样。发放签证的是DIAC，最终决定你入籍与否的也是DIAC，州政府在这些事务上没有任何权力。各个州的政府，在176签证的过程中唯一能够发挥影响的地方就是决定是否给你担保。因此，各个州的migration team（不是移民局！）才会要求你写一份东西告诉他们你为什么要来这个州。他们是基于这些材料以及自己的判断决定担保是否有利于本周的经济发展。在这之后，他们就没有任何的jurisdiction了。当然各个州的政府肯定很希望把自己的权力延伸到担保之后。不过要这样做，首先要修改OZ宪法，相信不是一朝一夕的事情。在这之前，鬼佬们肯定是play by rule的。

从另一方面来讲，这个小小的“漏洞”也并不一定是坏事。首先人才流动遵循市场价值才是最合理的。你到一个更加合适的州，和家人生活的更加愉快，工作的报酬更好，当然给联邦的纳税就更多，对整个OZ的经济贡献就更大。另一方面，如果当初给你发放担保是个错误，州政府也能从这个错误当中吸取教训，从而在将来把这个工作做得更好。假如没有这样的反馈的话，怎么会有教训呢？西方成熟的法律体系，也是在一个教训接着一个教训当中逐步完善的。

当然，各个州都有各个州的“州情”。One size does not fit all。具体情况还要具体掌握。希望这些对大家有些用处。
